Why hire an immigration lawyer?
The first thing to note when navigating the immigration rules is that they are inordinately complex. While other countries have relatively straight-forward rules and a simple application process, the UK immigration rules remains notoriously bureaucratic and overwhelmed with complicated jargon.
Hiring an immigration lawyer means an OISC-certified professional can assess your case and help you meet the requirements of your desired visa. This appointment is independent and free from Government interference.
Your immigration lawyer is here to help you achieve your desired outcome.
The points-based system
The UK’s decision to leave the European Union in 2016 has further inflicted complications into the system. What was once a Tiered route has been replaced by a points-based route, though some visa categories have remained the same. In layman’s terms, this means your eligibility will most likely hinge on your ability to score points based on your criteria and personal circumstances. For instance, you can score 10-20 points if you can prove you can speak English.
In order to be an immigration lawyer in the UK, you need to have passed a series of rigorous examinations. These are known as OISC qualifications. As such, OISC lawyers are required to keep up-to-date with changes in the immigration rules – including the new points-based system.
Not only are all our lawyers here in Birmingham OISC-certified, but we even teach the course for prospective immigration lawyers.
Save money in the long-run
It is also pertinent to note that, although an immigration lawyer may seem a costly upfront fee, hiring a professional is likely to save you money in the long-run.
Most UK Visas cost hundreds of pounds – if not thousands. Yet if you make even a marginal error in your application, or you fail to send the right documents to support your claim, you are likely to have your visa refused and consequently will lose all of the money you have paid. UKVI does not typically issue refunds, even if the fault of the application is not necessarily your fault.
It is highly recommended you seek an immigration lawyer when you apply for a Spouse Visa or British Citizenship. These two routes are infamous for refusals as the criteria can be so high that those who attempt the application alone are not usually successful.
When English is not your first language
If English is your second language, the immigration rules are even more intimidating. You will need to command a good degree of English ability in order to understand what criteria you need to meet and which documents you need to send as part of your portfolio of evidence.
An immigration lawyer can help you with all these things. Here at Birmingham Immigration Lawyers, we even have our own in-house translators to translate the advice and help you get to grips with the criteria.
If you’ve already been refused
If you have already been refused a visa, it makes best economic sense to invest in an immigration lawyer when you come to re-apply.
Depending on your reason for refusal, it could be harder to re-apply again, particularly if the refusal is in regards to your character or any past convictions. UKVI may also penalise you if you forget to include vital information, as the decision-maker will interpret this as deliberate deception.
Alternatively, you may wish to pursue an appeal. In this event, your immigration lawyer can even represent you at your Tribunal hearing.

Independent Visa advice
Although you may have your heart set on a certain UK Visa, it may not be the best route available for you.
The good thing about the UK immigration system is that there is a wide variety of visas. There are sub-categories of Work Visas, such as the NHS Visa, Skilled Worker Visa and Graduate Visa, and even different types of Family Visas.
Your application can also depend on where in the world you are physically applying from.
For this reason, it is best practice to seek independent visa advice from an immigration lawyer. Your lawyer can ‘match’ you with a suitable visa based on your individual circumstances and your intentions in the UK, for example if you are joining a family member or you are looking for long-term employment.
If your chosen visa has a high refusal rate
It is also worth being wary if your chosen visa has a high refusal rate.
The Innovator Visa (previously the Entrepreneur Visa) typically has a 50% refusal rate, making it as one of the most competitive and stringent applications to satisfy.
The UK Spouse Visa follows at a refusal rate of 25%. All partner visas, including the Fiancé Visa and Unmarried Partner Visa, shares similar requirements to the Spouse Visa and similarly will be met with the same scrutiny by UKVI. It is presumed that this is because the UK Government is attempting to crackdown on ‘sham marriages’ and fraudulent relationships that are set up for immigration advantages.
If you are a married couple or in a long-term relationship that is akin to marriage, you will need to prove with a wealth of documents and supporting evidence that you are genuinely together. This remains one of the highest bars across the immigration rules to pass as the test is largely subjective and might take some convincing on the immigration officer.
