Routes To Obtaining British Citizenship In The UK

As a UK resident who has legally lived in the country and obtained ILR, you can get British citizenship in different ways that include:

    British Citizenship by Birth

When a child is born, their parents’ situation typically determines if a child will automatically become a British citizen by birth. A child born in the UK to a settled person or a British citizen can acquire British citizenship by birth.

    • Children born before 1983: British citizenship would be conferred by birth for a child born in the UK before 1983 unless the child’s father worked for a non-UK country as a diplomat
    • Children born on or after January 1, 1983: You can qualify for British citizenship if you were born in the UK on or before January 1, 1983. You must be under 18 years old and have lived in the UK until you turned at least 10 years old. You’ll be conferred British nationality status when one of your parents gets a settled status or British citizenship

Children born to non-British parents in the UK are regarded as dependents. For this reason, they must obey the UK immigration rules as their parents do. Individuals who didn’t obtain British citizenship automatically by birth can apply to the Home Office to register as citizens of the United Kingdom.

    British Citizenship by Naturalisation

Non-UK citizens who were not born in the country may be able to obtain British citizenship by naturalisation. To qualify for this citizenship route, applicants must prove that they have lived in the country for up to 5 years, obtained ILR, and have lived for an additional year on ILR.

Applicants must meet the minimum stay requirements, meaning they must not have stayed outside the UK for more than 450 days during the 5 years. Also, the applicants must not have been absent from the UK for up to 90 days in the last year before applying for citizenship by naturalisation. Applicants seeking citizenship by naturalisation can complete the Home Office naturalisation application form online and await a decision within 3 to 6 months.

    British Citizenship by Marriage

Individuals married to British citizens can qualify for British citizenship by marriage. You won’t be automatically conferred British citizenship because you’re married to a British citizen or a person with settled status. To be eligible for British citizenship by marriage:

    • You must be in a civil partnership, married to a British citizen, or a settled person
    • You must be at least 18 years old before your application
    • You must continuously stay in the UK for 3 years before applying for British citizenship

    British Citizenship by Descent

The Citizenship by Descent route grants individuals born outside the UK the right to become British citizens because they have British parents. Individuals can obtain British citizenship by descent via registration or birth outside the United Kingdom to a British parent at birth. Note that any individual who obtains British citizenship by descent can’t pass the citizenship status to their child born outside the UK unless the person is crown-designated or in EU service.

Individuals’ dates of birth determine if they qualify for British citizenship by Descent. You can qualify for British citizenship by Descent if you were:

    • Born outside the UK on or after July 1, 2006 and one of your parents was a British citizen otherwise than by descent at their birth
    • Born outside the UK between 1983 and June 2006 provided that either your mother or father were British citizens otherwise than by descent at your birth
    • Born outside the UK before 1983 provided your father was a British citizen at the time of your birth
